The Ministry of communications has prepared a draft amendment to the communications law according to which the smartphone manufacturers will be obliged to deliver to Russia equipment with already installed applications of Russian developers. The draft law does not specify how many applications the producers will have to preinstall on the device. In turn, the Russian government will form a list of categories required for installation of programs. The publication explains that the amendments to the law will determine the type of software — messenger, maps, search engines, etc.
It is noted that the draft amendments to the legislation largely replicates the concept of the Federal Antimonopoly service (FAS) of Russia on the Russian preset applications on smartphones that was introduced earlier. In turn, the authorities have confirmed that a new amendment has already been agreed with the Ministry of communications.
The concept of FAS contains two main provisions that relate to the PE of the domestic applications on smartphones for the Russian market, as well as the option to completely remove pre-installed programs (except service, for the operation of equipment).
Earlier FAS already discussed the concept with market players. According to the Antimonopoly service for approval of the concept expressed by the Russian developers and operators: “Kaspersky Lab”, MTS, Mail.ru Group, MegaFon and others. It was opposed by representatives of foreign software developers and equipment: Apple, Microsoft, Intel and the Association of trading companies and manufacturers of consumer electronic and computer equipment (RATEK). The Antimonopoly service has promised to Refine the concept taking into account the constructive comments from the industry as well as experience of similar regulation in other countries.
